Every manufacturer who contravenes section 7.2 of the TVPA by manufacturing or selling a vaping product containing over 20 mg/mL nicotine, contrary to the Regulations, is guilty of an offence and liable (a) on summary of conviction to a fine not exceeding $500,000 or to imprisonment for a term not exceeding one year, or to both, or (b) on conviction on indictment to a fine not exceeding $1,000,000 or to imprisonment for a term not exceeding two years, or to both (see subsection 43(1) of the TVPA)
