In Held , a Montana trial court declared that portions of a Montana law that barred state agency officials from considering climate impacts and GHG emissions when conducting environmental reviews violated the youth-plaintiffs state constitutional right to a clean and healthful environment.8 The Held trial featured extensive testimony from climate scientists about the causes of climate change, its impacts in Montana and on the plaintiffs, Montanas GHG contributions, and the climate solutions the state could pursue to reduce its emissions.9 The state district courts 103-page opinion contained nearly 1,000 references to that testimony, and found that the youth plaintiffs constitutional right to a clean and healthful environment includes the right to a stable climate.10 The Montana Supreme Court affirmed the decision in December 2024.11 Constitutional and rights-based challenges are not confined to the United States, and are an increasingly significant trend worldwide (see Part I.B.2)
